In September 2022, Kapustin was fined under the administrative article on discrediting the armed forces (Art. 20.3.3 of the Code of Administrative Offences) because of a solitary picket in July 2022. He stood there with two posters: against the war and in support of Alexandra Skochilenko, Viktoria Petrova and Maria Ponomarenko, prosecuted for "fakes" about the army (part 2 of Art. 207.3 of the Criminal Code) as well as of Lilia Chanysheva, prosecuted for involvement in an extremist community (part 3 of Art. 282.1 of the Criminal Code). The picket, as stated in the ruling, "was accompanied by a musical composition". A criminal case was opened for discrediting the armed forces after Kapustin had left an anti-war comment on Telegram in January 2023.

Full summary
He repeatedly joined anti-war rallies in Krasnoyarsk, being regularly detained for that. The first time since the beginning of the Russian invasion he was detained on 26 February 2022 because of a jacket with a statement "No to War". There were similar detentions in May, June and July 2022. He also held solitary pickets in support of political prisoners and against the introduction of troops into Kazakhstan. In July 2023, a criminal case was opened against him for discrediting the Armed Forces of the Russian Federation. Kapustin was on a recognisance not to leave, however, since 11 January 2024 he has not appeared at meetings and was placed on the wanted list
