The case under Part 2 of Article 280 of the Criminal Code (public calls for extremist activity on the Internet) was initiated because of a post that Bainova published on her VKontakte page in July 2017. According to the defendant, she made the post on the social network after she and her daughter were told by the children in one of the city's cafes when entering the playroom that "only Russians are allowed in here". Bainova protested that Khakassia did not respect the people "to whom this land belongs" and characterised the extent of her outrage, adding: "At times like this I want to stage a revolution and a coup! To return the power, the land to our people! To reclaim it!"

Full summary
A resident of Abakan and populariser of Khakass culture, was accused of calling for extremist activity because of a post on VKontakte published in July 2017. The case under part 2 of article 280 of the Criminal Code (public calls for extremist activity on the Internet) was initiated in May 2018. In July Bainova was charged, in October the FSB (Federal Security Service) forwarded the indictment for approval to the Prosecutor's Office of Khakassia. On 26 November 2018, it became known that the Federal Security Service Directorate of Russia in the Republic of Khakassia terminated the criminal case. No corpus delicti was found in Bainova's actions. On 10 December 2018, the Prosecutor's Office of the Republic of Khakassia officially apologised to Bainova for the harm caused by the unjustified criminal prosecution.
