Case summary

On 26 February 2013, it became known that the Solntsevsky inter-district investigative department of Moscow opened a criminal case under part 1 of Article 282 of the Criminal Code (incitement to hatred or enmity, as well as humiliation of human dignity) against Alexander Bosykh, a member of the bureau of the presidium of the Rodina party. According to lawyer Oksana Mikhalkina, the investigator's ruling imputes to the member of the Rodina leadership the posting in social networks of texts by the fictitious online character Lev Shcharansky, which contain calls to incite hatred against social groups such as "tolerant individuals, experts, human rights activists, and homophobes." Bosykh's flat was searched and he was given a non-deportation undertaking.

On 27 February 2013, it was reported that Bosykh was charged with three entries in his Live Journal. The first of them belongs to the author of the journal and is a tendentious selection of criminal chronicles entitled "once again - not to name the nationality of the perpetrator? fuck you and your tolerance!!!", which concludes with the conclusion: "our main enemy is tolerant and corrupt bureaucratic creatures" and poorly veiled calls for violence against these categories. Two other entries are reprints from other journals. One is titled "Hand-wringing and conscientious! homophobes must die" and indeed contains open calls for violence, the other is just a parody of a text from Lev Shcharansky's blog, titled "Shcharansky's Commandments. Obligatory for the overthrow of the regime"
