According to the investigation, not later than 23 hours 45 minutes *** (Khabarovsk time), being in an unidentified place outside the Russian Federation, acting deliberately, realising the unlawful nature and public danger of his actions, foreseeing the inevitability of socially dangerous consequences in the form of undermining the authority and discrediting the existing state power and the Armed Forces of the Russian Federation, as well as the fact that his actions would mislead an unlimited number of people about the legality of the actions of the Armed Forces of the Russian Federation during the Special Military Operation, creating an impression that activities of Armed Forces of the Russian Federation as well as of state authorities of Russian Federation are unlawful and breaking the international law, expecting for citizens to feel anxiety, fear, worry, and lack of government protection, led by the motive of political hatred, having a dismissive, unfriendly, hostile feelings towards the Russian Federation authorities, knowing for sure that such actions would loudly resonate with public, decided on public dissemination of deliberately false information, including the information about using the Armed Forces of Russian Federation to defend the interests of Russian Federation and its citizens, and to support the international peace and security. In order to realise his criminal intent and to give maximum publicity to the deliberately false information he reported, during the period from 23 hours 45 minutes *** to 03 hours 17 minutes *** (Khabarovsk time), A.A. Kushnar, being in an unidentified place outside the Russian Federation, through an unidentified device used for access to the information and telecommunications network "Internet", being a user of the video hosting "YouTube" on the channel named "Forum of Free Russia" with the electronic address https://www.youtube.com/@freerussia/featured, where he is the host, access to which is available to an unlimited number of users of the video hosting "YouTube", realising that the material published on the channel will become available to an unlimited number of persons, having a single intention to commit the offence of "false information", knowing the unlawful nature and the danger to the public of his actions, foreseeing the inevitability of dangerous consequences in the form of eroding the authority and discrediting of government and of Armed Forces of the Russian Federation. as well as the face that his actions will mislead an unlimited number of people regarding the rightfulness of actions of Armed Forces of the Russian Federation during the Special Military Operation, creating an impression that activities of Armed Forces of the Russian Federation as well as of state authorities of Russian Federation are unlawful and breaking the international law, expecting for citizens to feel anxiety, fear, worry, and lack of government protection, led by the motive of political hatred, having a dismissive, unfriendly, hostile feelings towards the Russian Federation authorities, he knowingly communicated the following information on the aforementioned YouTube channel: During the period from 23 hours 45 minutes *** to 03 hours 17 minutes *** (Khabarovsk time) in the live broadcast on the above-mentioned channel during the broadcast with the title "LIVE: Results-2023. Big New Year's Eve Stream", publicly disseminated to an unlimited number of users of the video hosting "YouTube", under the guise of reliable reports containing knowingly false information about the actions of the Armed Forces of the Russian Federation on the territory of Ukraine during the special military operation, namely that the Armed Forces of the Russian Federation are involved in massive rocket attacks on residential neighbourhoods and civilian objects on the territory of Ukraine, which resulted in the death of civilians, including women and children, specifically naming the Special Military Operation as "full-scale Russian attack on Ukraine", the mean of conducting warfare by Armed Forces of the Russian Federation as "mean of specifically aerial assault", actions of Russian military during the Special Military Operation as "yet another terror act of massive rocket strikes" or as "bloody terror act by Moscow" or as "Russian terror", the Russian government as "archetypal evil", referencing the Headquaters of Ukraine Armed Forces as an official source.
