On 11 October 2016, she was charged with arbitrariness. The consideration of the case in court began in January 2017. Magistrate judge issued two private rulings against Lutovinova's lawyer Dmitry Sotnikov on 3 and 20 February, he was accused of allegedly violating the order in the courtroom and not appearing at court hearings on days when Lutovinova took sick leave. On 1 March 2017, magistrate judge Zotova decided to elect a preventive measure against Lutovinova in the form of detention in the Federal Institution of the Federal Penitentiary Service SIZO-11 of the Federal Penitentiary Service of Russia for the Moscow region. The judge motivated her decision by the fact that Lutovinova allegedly chronically failed to appear at court hearings, thus hindering the consideration of the case. On 6 March it became known that Lutovinova was released on her own recognisance. On 16 March 2017 Lutovinova was sentenced to 350 hours of compulsory labour, but taking into account the days spent in custody, the punishment was reduced to 302 hours. In addition, the court satisfied nine civil claims of the "victims", obliging Lutovinova to pay them a total of 650 thousand rubles.
