According to the investigation, since at least February 2017 he had been an active member of Hizb ut-Tahrir and, together with Azamat Eyupov, Enver Omerov, Riza Omerov, and Aider Dzhapparov, “organized the activities of a cell” of the organization in the town of Belogorsk, Republic of Crimea. He allegedly “carried out covert anti-Russian, anti-constitutional activities” in the area, encouraged local residents to join Hizb ut-Tahrir, directed the cell’s activities, organized clandestine meetings, instructed participants on “identifying and recruiting new members” to Hizb ut-Tahrir, assigned roles, established security measures, and monitored their compliance.

Resident of Belogorsk (Crimea). Not officially employed, married, has two minor children. On 9 February 2022, detained and on the same day taken into custody on the case of organisation of activities of a terrorist organisation and preparation for violent seizure of power in connection with the alleged involvement in the Islamist party "Hizb ut-Tahrir", which has nothing to do with terrorism. On 30 November 2022, sentenced to 17 years in a strict regime colony.
In June 2023, it became known that before the appeal Mustafayev was given only 15 days to familiarise himself with 7,300 pages of the case.
In 2025, he was deprived of Russian citizenship.
