According to the prosecution, on 26 September 2022, he posted in the Telegram channel "Sarma. Talk" on behalf of the user "FreeSiberia" "under the publication about the commission of a terrorist act by Zinin in Ust-Ilimsk, Irkutsk region, on 26 September 2022 (on 19 January 2024, Zinin was convicted by the 1st Eastern District Military Court for committing crimes under p. "in" part 2 of article 205 of the Criminal Code of the Russian Federation, part 1 of article 223 of the Criminal Code of the Russian Federation, part 1 of article 222 of the Criminal Code of the Russian Federation) text commentary justifying the commission of this terrorist act". Apparently, this refers to the following, very short comment of the FreeSiberia user: "Like!", with which he reacted to the published video of the attack on the military commander in Ust-Ilimsk. The prosecution regarded this one-word comment as a public justification of terrorism committed with the use of the Internet and qualified it under part 2 of article 205.2 of the Criminal Code of the Russian Federation. There are no other comments by Baksheev under this publication. On 2 October 2022, "in the Internet group "FreeSiberia" through a personal account with the name "Sergei", in a public news group with the name "Sarma. Talk" <...> published <...> a text comment containing calls for extremist activity, namely hostile, violent actions against a social group of servicemen of the Armed Forces of the Russian Federation". The comment in question is: "Kill the officers, go home. Or to Moscow, you have weapons. The enemy is not in Ukraine - the enemy is in the Kremlin". The investigation and the court qualified this statement as a public call for extremist activity on the Internet (part 2 of article 280 of the Criminal Code of the Russian Federation). On November 1, 2022, in the Telegram-group "Irkutsk blog" under the publication about the collection of humanitarian aid to the RF Armed Forces servicemen in the zone of the so called Special military operation "published <...> a text comment containing calls to finance the Armed Forces of Ukraine within the framework of the Special military operation, namely to commit a crime under Art. 275 of the Criminal Code of the Russian Federation, i.e. activities against the security of the Russian Federation". Apparently, it could be about this comment of the FreeSiberia user: "Yes, you can still donate to the Ukrainian Armed Forces. For example, Kamil Galeyev regularly collects https://t.me/kamil_galeev/2833 This is if you want fewer Wagnerites and deranged volunteers to come home." Just below, another comment by this user was published, specifying: "This is for the Ukrainian armed forces, so that more mobiks are made fertilizer". On 24 November 2022, in a public newsgroup with the name "Sarma. Talk" again published a text comment "containing calls for the financing of the Armed Forces of Ukraine in the framework of the Special military operation and calls against the partial mobilisation in the Russian Federation, namely to commit an offence under Article 275 of the Criminal Code of the Russian Federation, i.e. activities against the security of the Russian Federation". This refers to the following comment by the user FreeSiberia: "You can also donate to the AFU or help with the CIA's information - also a good deed for a good cause". The court qualified these comments under paragraph "c" of part 2 of article 280.4 of the Criminal Code of the Russian Federation ("Public calls to carry out activities against the security of the state, committed with the use of the Internet network."). On 1 December 2022, in the Telegram-group "Irkutsk blog" under the publication "on bringing Timofeev to criminal responsibility for justifying a terrorist act committed on 1 April 2022 against the fuel and energy complex, as well as economic infrastructure facilities located in the Belgorod region, published a text comment justifying the commission of this terrorist act". Apparently, this comment by the user FreeSiberia may be the one in question: "Terrorism is a tactic of intimidation. This is what rf is doing, destroying Ukraine's energy infrastructure. And the attack on the Russian oil depot is a well-planned and brilliantly executed military operation. Not only pilots, but also staffers should be given hero status. And even heroes of Russia. The investigation and the court qualified the posting of this comment under part 2 of article 205.2 of the Criminal Code of the Russian Federation ("Public justification of terrorism committed with the use of the Internet").
