Two of the three episodes of the charge of public justification of terrorism relate to comments left in May 2023 under the publications of Larisa Pimonova, a St. Petersburg resident who was later handed a two years' suspended sentence in a case of “fake news” about the Russian Armed Forces. The posts were about drone strikes on the Kremlin, with one of the comments cited in the charges against Mitrofanov reading “Russia's enemies are in the Kremlin” and another saying “Beauty!!!! Fighting mosquitoes are on the case.” According to the investigation, he also left a comment under a video in which he expressed “a negative assessment of persons grouped on the basis of their affiliation with law-enforcement bodies.”

On May 5, 2023, Mitrofanov was sentenced to 7 years' imprisonment in a general regime penal colony.
