According to the investigation, while located at <address> , being a user of the publicly accessible telecommunications network “the Internet” (hereinafter – the Internet), using his Apple mobile telephone, model iPhone 14 Pro, he familiarised himself—inter alia with the use of software for translation from Ukrainian into Russian—on the video-hosting platform YouTube, with a publication containing text beginning with the words ‘ПРОШУ ПIДТРИМАТИ ЗБIP’ (translated from Ukrainian as ‘please support the fundraiser’) and ending with the words ‘Номер картки банки…’ (translated from Ukrainian as ‘bank card number…’). As a result, D.E. Salikhov, being aware of the prohibition on activities carried out within the territory of the Russian Federation that are directed against the security of the Russian Federation, and also harbouring dissatisfaction with Russia’s special military operation in Ukraine and hostility towards the political regime of the Russian Federation, formed a criminal intent aimed at publicly calling upon an indefinite circle of persons to provide financial assistance to a foreign state in activities directed against the security of the Russian Federation, that is, to commit an offence according to Article 275 of the Criminal Code of the Russian Federation. In order to implement this criminal intent, on DD.MM.YYYY, between 20:30 and 20:47 (Vladivostok time), D.E. Salikhov, while at <address> , took an electronic screenshot on his Apple iPhone 14 Pro displaying the above-mentioned publication, which he saved in the memory of the device. Subsequently, on DD.MM.YYYY at 20:47, D.E. Salikhov, while at <address> , being an Internet user, acting intentionally and motivated by political hatred, fully aware of the unlawfulness and social danger of his actions, their public nature, and the fact that the text captured in the previously taken screenshot contained appeals to provide financial assistance to a foreign state—Ukraine—in activities directed against the security of the Russian Federation (that is, calls to commit an offence according to Article 275 of the Criminal Code of the Russian Federation), foreseeing the possibility and inevitability of socially dangerous consequences in the form of inciting an indefinite number of Internet users to commit such an offence, and desiring such consequences, using his Apple iPhone 14 Pro with Internet access, published on the Internet, in his personal profile of the publicly accessible messaging application WhatsApp, in the Status section accessible to an unlimited number of users of the said application who have the mobile number (984)158-24-92 in their contacts, a publication containing text beginning with the words ‘ПРОШУ ПIДТРИМАТИ ЗБIP’ (‘please support the fundraiser’) and ending with the words ‘Номер картки банки…’ (‘bank card number…’). According to expert report No. dated DD.MM.YYYY, this publication contains linguistic and psychological features of inducement to actions aimed at collecting funds (including the indication of a bank card number) in the amount of 78,000 hryvnias for the purpose of purchasing an optical sight for the 61st Brigade, namely the 61st Separate Mechanised Steppe Brigade, which forms part of the Armed Forces of Ukraine and whose activities are directed against the security of the Russian Federation.
