According to the investigation, from 23:00pm on the 14th of March 2019 to 06:10am on the 15th of March 2019, together with Vyacheslav Grigoryants, on the road adjacent to the territory of the railway station [address], in the area of the 65th block of the Urdomsky district forest area of the Yarensky forestry [address], facing from [address] towards the Republic of K., Dzyuba entered with Starkovsky A.S., Drobinin D.V. and other persons unidentified by the investigation into a preliminary criminal conspiracy to commit unlawful actions against the employees of LLC "SeverStroyTrans". These actions were aimed at stopping the convoy of equipment by damaging it and using physical violence against the employees of LLC "SeverStroyTrans" who were escorting the equipment, as well as against any other persons preventing their criminal actions. To achieve this, having distributed the roles amongst themselves prior, they decided to put a mobile biaxial trailer 100 meters from the gates of the train station [address] that was facing towards the direction to the Republic of K., with the intention of blocking any equipment travelling through the area. They also agreed that in case their demands are met with resistance, together they will commit violence against the staff escorting the equipment, as well as damage the equipment itself. From 23:00pm on the 14th of March 2019 to 06:10am on the 15th of March 2019, according to the investigation, Dzyuba was together with Vyacheslov Grigoryants on the road adjacent to the territory of the railway station [address], in the area of the 65th black of the Urdomsky forest area of the Yarensky forestry [address], at a distance of about 755 metres from the railway station's gates [address] that were facing towards the Republic of Karelia. Having unlawfully given themselves the authority to restrict the constitutional rights of citizens of the Russian Federation to the inviolability of the person (Article 22 of the Constitution of the Russian Federation) and to freedom of movement (Article 27 of the Constitution of the Russian Federation), after the excavator "HITACHI ZX200-3" -- state registration plate KK 7321 11 -- was damaged and could not be moved to the railway station [address], they used physical violence against Alexei Kozlov and, with their hands and legs, hit him across the head and body no less than 40 times. More specifically, after Grigoryants, Starkovksy, Drobinin and other persons unidentified by the investigation dragged Kozlov from the excavator, at the agreed upon location, acting unlawfully and intentionally, Dzyuba hit Kozlov across the head and body no less than 10 times, from which the aforementioned experienced physical pain. During the same period of time, i.e. between 23:00pm on the 14th of March 2019 and 06:10am on the 15th of March 2019, on the said road, acting together with persons unidentified by the investigation, Dzyuba deliberately grabbed [another victim], who was moving in the said convoy of equipment of LLC "SeverStroyTrans", laid him on the ground, and tied the victim's hands with his belt. Having bent the victim's hands behind his back, Dzyuba and his unidentified accomplices caused physical pain to the victim through their joint actions. Then, together with Vyacheslav Grigoryants as part of a group of persons by prior conspiracy, together with Starkovsky, Drobinin and persons unidentified by the investigation, during the same period of time and on the same road, after having beaten Kozlov and given themselves the authority to restrict the constitutional rights of citizens of the Russian Federation to the inviolability of the person (article 22 of the Constitution of the Russian Federation), as well as the freedom of movement (article 27 of the Constitution of the Russian Federation), Dzyuba unlawfully held Kozlov [and the other victim] in his custody and forced them to stay outside in the cold for three hours straight. During this time, they were humiliated and subjected to cruelty. Moreover, from 23:00pm on the 14th of March 2019 to 6:10am on the 15th of March 2019, Dzyuba, who was on the road adjacent to the territory of the railway station [address], in the area of the 65th block of the Urdomsky district forest area of the Yarensky forestry [address], demonstrated a small infantry spade (i.e. a sapper spade) at his disposal (which can be used as a melee weapon), as well as his willingness to use it to cause Kozlov bodily harm. Feeling true dislike for Kozlov and wishing to frighten him and make him fear for his life and health, Dzyuba made a death threat against Kozlov, which he, taking into account the situation in which he found himself, took seriously and started fearing for his life.
