Case summary
Served in the Ukrainian "Aidar" battalion, a medic. Captured in the spring of 2022, was in the occupied territory of Donetsk region of Ukraine. Was charged under a number of articles of the Criminal Code of the self-proclaimed Donetsk People's Republic (DNR). After the Russian Federation proclaimed the DNR part of its territory, the charges were reclassified in accordance with the Criminal Code of the Russian Federation: Mishchenko was accused of participation in the activities of a terrorist organisation and violent seizure of power. Human rights activists noted that she was a prisoner of war, so she should not have been held criminally liable for actually participating in hostilities, and in addition, they consider the charges absurd.
On 12 September 2024, the court decided to separate the case of Mishchenko and another woman accused in the same case, Lilia Prutyan, into separate proceedings, as they were also prosecuted for the use of prohibited methods of warfare.
The next day, Ukrainian President Volodymyr Zelenskyy said that Mishchenko and Prutyan had been returned to Ukraine as part of the prisoners of war exchange.
